THE PEOPLE, Plaintiff and Respondent, v. ALPHONSO HOWARD, Defendant and Appellant.

(Superior Court of Los Angeles County, No. A646953-01, J. D. Smith, Judge.)

OPINION

CORRIGAN, J.-

Defendant Alphonso Howard was sentenced to death after a jury convicted him of first degree murder, rape, and a forcible lewd act upon a child under the age of 14. The jury found that he personally used a firearm during the offenses, fn. 1 and that he caused bodily injury to the child while committing the lewd act. fn. 2 The special circumstances supporting the imposition of the death penalty were that the rape and forcible lewd act upon a child occurred while defendant committed the murder. fn. 3 We affirm the judgment. {Slip Opn.
